  144. Uniform Resource Identifier (URI) for, this License with every
  145. copy of the Work You Distribute or Publicly Perform. You may not
  146. offer or impose any terms on the Work that restrict the terms of

  149. the License. You may not sublicense the Work. You must keep
  150. intact all notices that refer to this License and to the

  152. Distribute or Publicly Perform. When You Distribute or Publicly
  153. Perform the Work, You may not impose any effective technological
  154. measures on the Work that restrict the ability of a recipient of
  155. the Work from You to exercise the rights granted to that
  156. recipient under the terms of the License. This Section 4(a)
  157. applies to the Work as incorporated in a Collection, but this
  158. does not require the Collection apart from the Work itself to be
  159. made subject to the terms of this License. If You create a
  160. Collection, upon notice from any Licensor You must, to the
  161. extent practicable, remove from the Collection any credit as
  162. required by Section 4(f), as requested. If You create an
  163. Adaptation, upon notice from any Licensor You must, to the
  164. extent practicable, remove from the Adaptation any credit as
  165. required by Section 4(f), as requested.
  166. b. Subject to the exception in Section 4(e), you may not
  167. exercise any of the rights granted to You in Section 3 above in

  171. digital file-sharing or otherwise shall not be considered to be
  172. intended for or directed toward commercial advantage or private
  173. monetary compensation, provided there is no payment of any
  174. monetary compensation in connection with the exchange of
  175. copyrighted works.
  176. c. If the Work meets the definition of Software, You may exercise
  177. the rights granted in Section 3 only if You provide a copy of the
  178. corresponding Source Code from which the Work was derived in digital
  179. form, or You provide a URI for the corresponding Source Code of
  180. the Work, to any recipients upon request.
  181. d. If the Work is used as or for a Web Service, You may exercise
  182. the rights granted in Section 3 only if You provide a copy of the
  183. corresponding Source Code from which the Work was derived in digital
  184. form, or You provide a URI for the corresponding Source Code to the
  185. Work, to any recipients of the data served or modified by the Web
  186. Service.
  187. e. You may exercise the rights granted in Section 3 for
  188. commercial purposes only if you satisfy any of the following:
  189. i. You are a worker-owned business or worker-owned
  190. collective; and
  191. ii. after tax, all financial gain, surplus, profits and
  192. benefits produced by the business or collective are
  193. distributed among the worker-owners
  194. iii. You are not using such rights on behalf of a business
  195. other than those specified in 4(e.i) and elaborated upon in
  196. 4(e.ii), nor are using such rights as a proxy on behalf of a
  197. business with the intent to circumvent the aforementioned
  198. restrictions on such a business.
  199. f. Any use by a business that is privately owned and managed,
  200. and that seeks to generate profit from the labor of employees
  201. paid by salary or other wages, is not permitted under this
  202. license.
  203. g. If You Distribute, or Publicly Perform the Work or any
  204. Adaptations or Collections, You must, unless a request has been
  205. made pursuant to Section 4(a), keep intact all copyright notices
  206. for the Work and provide, reasonable to the medium or means You
  207. are utilizing: (i) the name of the Original Author (or
  208. pseudonym, if applicable) if supplied, and/or if the Original
  209. Author and/or Licensor designate another party or parties (e.g.,
  210. a sponsor institute, publishing entity, journal) for attribution
  211. ("Attribution Parties") in Licensor!s copyright notice, terms of
  212. service or by other reasonable means, the name of such party or
  213. parties; (ii) the title of the Work if supplied; (iii) to the
  214. extent reasonably practicable, the URI, if any, that Licensor
  215. specifies to be associated with the Work, unless such URI does
  216. not refer to the copyright notice or licensing information for
  217. the Work; and, (iv) consistent with Section 3(b), in the case of
  218. an Adaptation, a credit identifying the use of the Work in the
  219. Adaptation (e.g., "French translation of the Work by Original
  220. Author," or "Screenplay based on original Work by Original
  221. Author"). The credit required by this Section 4(f) may be
  222. implemented in any reasonable manner; provided, however, that in
  223. the case of a Adaptation or Collection, at a minimum such credit
  224. will appear, if a credit for all contributing authors of the
  225. Adaptation or Collection appears, then as part of these credits
  226. and in a manner at least as prominent as the credits for the
  227. other contributing authors. For the avoidance of doubt, You may
  228. only use the credit required by this Section for the purpose of
  229. attribution in the manner set out above and, by exercising Your
  230. rights under this License, You may not implicitly or explicitly
  231. assert or imply any connection with, sponsorship or endorsement
  232. by the Original Author, Licensor and/or Attribution Parties, as
  233. appropriate, of You or Your use of the Work, without the
  234. separate, express prior written permission of the Original
  235. Author, Licensor and/or Attribution Parties.
  236. h. For the avoidance of doubt:
  237. i. Non-waivable Compulsory License Schemes. In those
  238. jurisdictions in which the right to collect royalties
  239. through any statutory or compulsory licensing scheme
  240. cannot be waived, the Licensor reserves the exclusive
  241. right to collect such royalties for any exercise by You of
  242. the rights granted under this License;
  243. ii. Waivable Compulsory License Schemes. In those
  244. jurisdictions in which the right to collect royalties
  245. through any statutory or compulsory licensing scheme can
  246. be waived, the Licensor reserves the exclusive right to
  247. collect such royalties for any exercise by You of the
  248. rights granted under this License if Your exercise of such
  249. rights is for a purpose or use which is otherwise than
  250. noncommercial as permitted under Section 4(b) and
  251. otherwise waives the right to collect royalties through
  252. any statutory or compulsory licensing scheme; and,
  253. iii.Voluntary License Schemes. The Licensor reserves the
  254. right to collect royalties, whether individually or, in
  255. the event that the Licensor is a member of a collecting
  256. society that administers voluntary licensing schemes, via
  257. that society, from any exercise by You of the rights
  258. granted under this License that is for a purpose or use
  259. which is otherwise than noncommercial as permitted under
  260. Section 4(b).
  261. i. Except as otherwise agreed in writing by the Licensor or as
  262. may be otherwise permitted by applicable law, if You Reproduce,
  263. Distribute or Publicly Perform the Work either by itself or as
  264. part of any Adaptations or Collections, You must not distort,
  265. mutilate, modify or take other derogatory action in relation to
  266. the Work which would be prejudicial to the Original Author's
  267. honor or reputation. Licensor agrees that in those jurisdictions
  268. (e.g. Japan), in which any exercise of the right granted in
  269. Section 3(b) of this License (the right to make Adaptations)
  270. would be deemed to be a distortion, mutilation, modification or
  271. other derogatory action prejudicial to the Original Author's
  272. honor and reputation, the Licensor will waive or not assert, as
  273. appropriate, this Section, to the fullest extent permitted by
  274. the applicable national law, to enable You to reasonably
  275. exercise Your right under Section 3(b) of this License (right to
  276. make Adaptations) but not otherwise.
  277. 5. REPRESENTATIONS, WARRANTIES AND DISCLAIMER
  278. UNLESS OTHERWISE MUTUALLY AGREED TO BY THE PARTIES IN WRITING, LICENSOR
  279. OFFERS THE WORK AS-IS AND MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY
  280. KIND CONCERNING THE WORK, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE,
  281. INCLUDING, WITHOUT LIMITATION, WARRANTIES OF TITLE, MERCHANTIBILITY,
  282. FITNESS FOR A PARTICULAR PURPOSE, NONINFRINGEMENT, OR THE ABSENCE OF
  283. LATENT OR OTHER DEFECTS, ACCURACY, OR THE PRESENCE OF ABSENCE OF
  284. ERRORS, WHETHER OR NOT DISCOVERABLE. SOME JURISDICTIONS DO NOT ALLOW
  285. THE EXCLUSION OF IMPLIED WARRANTIES, SO SUCH EXCLUSION MAY NOT APPLY TO
  286. YOU.
  287. 6. LIMITATION ON LIABILITY
  288. EXCEPT TO THE EXTENT REQUIRED BY APPLICABLE LAW, IN NO EVENT WILL
  289. LICENSOR BE LIABLE TO YOU ON ANY LEGAL THEORY FOR ANY SPECIAL,
  290. INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES ARISING OUT OF
  291. THIS LICENSE OR THE USE OF THE WORK, EVEN IF LICENSOR HAS BEEN ADVISED
  292. OF THE POSSIBILITY OF SUCH DAMAGES.
  293. 7. TERMINATION
  294. a. This License and the rights granted hereunder will terminate
  295. automatically upon any breach by You of the terms of this
  296. License. Individuals or entities who have received Adaptations
  297. or Collections from You under this License, however, will not
  298. have their licenses terminated provided such individuals or
  299. entities remain in full compliance with those licenses. Sections
  300. 1, 2, 5, 6, 7, and 8 will survive any termination of this
  301. License.
  302. b. Subject to the above terms and conditions, the license
  303. granted here is perpetual (for the duration of the applicable
  304. copyright in the Work). Notwithstanding the above, Licensor
  305. reserves the right to release the Work under different license
  306. terms or to stop distributing the Work at any time; provided,
  307. however that any such election will not serve to withdraw this
  308. License (or any other license that has been, or is required to
  309. be, granted under the terms of this License), and this License
  310. will continue in full force and effect unless terminated as
  311. stated above.
  312. 8. MISCELLANEOUS
  313. a. Each time You Distribute or Publicly Perform the Work or a
  314. Collection, the Licensor offers to the recipient a license to
  315. the Work on the same terms and conditions as the license granted
  316. to You under this License.
  317. b. Each time You Distribute or Publicly Perform an Adaptation,
  318. Licensor offers to the recipient a license to the original Work
  319. on the same terms and conditions as the license granted to You
  320. under this License.

  323. a copy and/or URI of the corresponding Source Code on the same
  324. terms and conditions as the license granted to You under this License.
  325. d. If the Work is used as a Web Service, each time You Distribute
  326. or Publicly Perform an Adaptation, or serve data derived from the
  327. Software, the Licensor offers to any recipients of the data a copy
  328. and/or URI of the corresponding Source Code on the same terms and
  329. conditions as the license granted to You under this License.
  330. e. If any provision of this License is invalid or unenforceable
  331. under applicable law, it shall not affect the validity or
  332. enforceability of the remainder of the terms of this License,
  333. and without further action by the parties to this agreement,
  334. such provision shall be reformed to the minimum extent necessary
  335. to make such provision valid and enforceable.
  336. f. No term or provision of this License shall be deemed waived
  337. and no breach consented to unless such waiver or consent shall
  338. be in writing and signed by the party to be charged with such
  339. waiver or consent.
  340. g. This License constitutes the entire agreement between the
  341. parties with respect to the Work licensed here. There are no
  342. understandings, agreements or representations with respect to
  343. the Work not specified here. Licensor shall not be bound by any
  344. additional provisions that may appear in any communication from
  345. You. This License may not be modified without the mutual written
  346. agreement of the Licensor and You.
  347. h. The rights granted under, and the subject matter referenced,
  348. in this License were drafted utilizing the terminology of the

  350. Works (as amended on September 28, 1979), the Rome Convention of
  351. 1961, the WIPO Copyright Treaty of 1996, the WIPO Performances
  352. and Phonograms Treaty of 1996 and the Universal Copyright
  353. Convention (as revised on July 24, 1971). These rights and
  354. subject matter take effect in the relevant jurisdiction in which
  355. the License terms are sought to be enforced according to the
  356. corresponding provisions of the implementation of those treaty
  357. provisions in the applicable national law. If the standard suite
  358. of rights granted under applicable copyright law includes
  359. additional rights not granted under this License, such
  360. additional rights are deemed to be included in the License; this
  361. License is not intended to restrict the license of any rights
  362. under applicable law.
